At a Monday night ACT UP meeting in September 1989, it was brought to the floor that a gay man had been kicked out of the ER at St. Vincents Hospital by a security guard because he had dared to kiss his lover. A heated conversation ensued and eventually the whole room got up, walked around the corner to the hospital and took over the waiting room in the ER. As a result, the hospital agreed to meet with representatives of ACT UP.<br />

Several ACT UP members met with the president of the hospital and the executive board, which resulted in sensitivity training for all of their employees.

They received notoriety when they were successfully sued in 1991 by MGM Pictures, the owner of the rights the Pink Panther cartoon. The neighborhood watch group would patrol areas, between midnight and 3 A.M. on Fridays and Saturdays, that had a large number of gang assaults on gays and lesbians.

The defendants, Gregg Bordowitz, Velma Campbell, Cynthia Cochran, Richard Elovich, Phillip Flores, Debra Levine, Kathryn Otter, Jon Stuen Parker, Monica Pearl and Dan Keith Williams were arrested on March 6, 1990 after they set up a table in Lower Manhattan and tried to give clean hypodermic needles to drug addicts to prevent them from getting AIDS. Most of the eight defendants were members of ACT UP (AIDS Coalition to Unleash Power).<br />

During the six-day trial, which took place in April of 1991, the former Health Commissioner, Dr. Stephen C. Joseph, who started the pilot needle-exchange program, testified in behalf of the defendants.

Drager presided over the trial of Gregg Bordowitz, Velma Campbell, Cynthia Cochran, Richard Elovich, Phillip Flores, Debra Levine, Kathryn Otter, Jon Stuen Parker, Monica Pearl and Dan Keith Williams who were arrested on March 6, 1990 after they set up a table in Lower Manhattan and tried to give clean hypodermic needles to drug addicts to prevent them from getting AIDS. Most of the eight defendants were members of ACT UP (AIDS Coalition to Unleash Power).<br />

In her ruling, Judge Drager invoked the so-called necessity justification in the state penal law. It states that "conduct which would otherwise constitute an offense is justifiable and not criminal when such conduct is necessary as an emergency measure to avoid an imminent public or private injury."

  • On July 25, 1989, Walter Armstrong and Sandor Katz, members of ACT UP, demonstrated in front of New York Times publisher Punch Sulzberger's residence at 1010 Fifth Avenue and then marched to West 43rd Street offices of the paper. After threatening a sit-in in Times Square, the protesters were finally allowed to picket on the sidewalk opposite the Times. Several demonstrators held a die-in in front of the building.
